Purpose
The City Attorney's
office shall conduct all the legal business in which the City of Midland has an interest.
The office provides day-to-day advice and consultation, document drafting, legal
research, legal representation to the City Council, the City Manager, the City's boards,
commissions and various committees, its departments and staff. In addition, this
office
provides information and assistance to the general public and other local, state and
federal government entities and municipal government associations and organizations.
Duties of the City Attorney
-
Attend all City Council
meetings and all administrative, board, commission and committee meetings as
needed.

Research, draft and review
all ordinances, policies, legal documents, agreements and contracts. Research, draft and
review resolutions, memoranda, agendas and correspondence as needed.

Consult and provide counsel
to the City's elected and appointed officials,
administrative staff, members of all boards, commissions and committees, City staff and
employees.

Negotiate or assist in
negotiation of contracts, agreements and real estate transactions as needed.

Provide information to the
general public, other local, state and federal governmental agencies and municipal
government associations.

Provide training to elected
and appointed officials, administrative staff, members of all boards, commissions and
committees, City staff and employees for policies regarding federal, state and local rules
and regulations.

Prosecute all ordinance
violations from complaint issuance to trial.

Prosecute or defend civil
court actions and coordinate legal services with contracted legal counsel and insurance
carriers.

Monitor, review and
publicize, when necessary, legislative and administrative matters of other governmental
agencies and make necessary recommendations to the appropriate elected and appointed
officials, administrative staff, boards, commissions and committees, City staff and
employees.
