MINUTES OF THE MEETING OF THE PLANNING COMMISSION,

WHICH TOOK PLACE ON TUESDAY, SEPTEMBER 13, 2005, 7:00 P.M.,

COUNCIL CHAMBERS, CITY HALL, MIDLAND, MICHIGAN

1. Roll Call

PRESENT: Eyre, Gaynor, Kozakiewicz, Mead, Rapanos, Senesac, and Svenson

ABSENT:

OTHERS PRESENT: Jon Lynch, Assistant City Manager; Daryl Poprave, City Planner; Cheri Standfest, Community Development Specialist; and 32 others.

2. Approval of Minutes

Regular Meeting of August 23, 2005

It was moved by Eyre and supported by Kozakiewicz to approve the minutes of August 23rd. The minutes were unanimously approved.

3. Public Hearings

Hours of Operation Restrictions – Consideration of a petition initiated by the Planning

Commission to expand hours of operation by businesses located in the Neighborhood

Commercial zoning districts from 7:00 a.m. – 11:00 p.m. to operations on a 24 hour per

day basis. [See transcript.]

6. New Business

It was moved by Svenson and seconded by Mead to keep the calendar for the coming year on the second and fourth Tuesday of the month except for the fourth Tuesday in December – Svenson/Mead. Unanimously approved.

We also have 3 people heading to Mackinac Island for the MAP Conference.

§ Public hearing, Zoning Petition No. 522 – Consideration of a petition initiated by the Planning Commission to rezone approximately 1.09 acres located at the south side of the parcel at 2810 East Wheeler Street from Midland Township Residential R-1 to City of Midland Residential A-4 zoning.

§ Public hearing, Zoning Petition No. 523 – Consideration of a petition initiated by John Rapanos to rezone approximately 1.14 acres located at the west side of the parcel at 2810 East Wheeler Street from Residential A-1 to Residential A-4 zoning.

§ Public hearing, Conditional Use Permit No. 20 - Consideration of a petition initiated by Faulk & Foster on behalf of IPCS Wireless for conditional use permit approval to allow collocation of telecommunications equipment and increase of tower height at 1730 N Saginaw Road.

ZONING BOARD OF APPEALS

§ 05-15 - Subway for an area/dimension variance to permit an additional wall sign on the Wal-Mart store near the food center entrance at 910 Joe Mann Blvd.

§ 05-16 – Lapham’s Flowers for an extension of a previously approved temporary permit at 1412 North Saginaw Road.

§ 05-17 – Mark Kohtz for an area/dimension variance to permit a 6 foot tall privacy fence to exist in the side yard setback at 2507 Greenwich Circle.

§ 05-18 – Fifth Third Bank for an area/dimension variance to permit four (4) signs on an ATM machine located at 6641 Cinema Drive.

DIRECTOR’S NOTES

§ Interviews of firms responding to the City’s RFP for services to update the master plan are scheduled for October 14^th. The preparation meeting is scheduled for 8:00 a.m. on October 7^th.

§ 2006-2007 Planning Commission meetings will again be scheduled for the second and fourth Tuesday of each month (with exception of December which is only the second Tuesday) at 7:00 p.m.
