2. Approval of
Minutes
Moved by Senesac, seconded by Brown,
to approve the minutes of the regular meeting of October 28, 2008 as written. Motion passed unanimously.

5. New Business
Daryl Poprave introduced the proposed 2009 Zoning
Ordinance amendments.
The Zoning Ordinance became effective on January 1,
2005. Previous zoning changes were made
in 2006 and 2007. The Planning
Commission is considering additional changes, which are outlined below.

Section 3.01J – require bicycle racks
Table 3.2 – projections into yards

6. Old Business
a. Conditional
Use Permit No. 33, the request of Midland County Habitat for Humanity
for the construction of a single family home located at 309
E. Grove Street. This property
is located in a Residential B zoning district.
Mr.
Baker gave an overview of the property.
The property is zoned Residential B.
The property is located between Rodd Street and Townsend Street. Discretionary standards are determined by the
Planning Commission during deliberation on the petition. Staff recommends approval and it is suitable
for single family use. Habitat for
Humanity is partnering with Delta College to have the building trades class work on the home.
Ms.
Hanna asked about the number of vehicles this family would have and the
driveway would only accommodate two cars.
Gary Jones, 712 Heathermoor Drive, Executive Director of Habitat. With regard to the parking, it is going to be
a single family home that the Affordable Housing Alliance will be responsible
for.
Mr.
Mead asked if this will be a single family living there continually. The original concept came from MSDHA and they
will be families managed by the Affordable Housing Alliance. It isn’t going to be sold to a family, it will be a rental property.
Motion by Gaynor, seconded by Eyre, to recommend
to City Council approval of Conditional Use Permit No. 33:
Mr.
Senesac feels that this clearly meets the discretionary and nondiscretionary
standards so he supports it. Ms. Brown
supports also. Mr. Mead feels this is a
good use for the property, he supports it too.
Mr. Gaynor states it is a good use and a good cause. Ms. Svenson agrees.
YEAS: Brown, Eyre, Gaynor, Hanna, King, Mead,
Senesac and Svenson

Motion
approved 8-0.
b. Zoning
Petition No. 555 initiated by Soil Tech, Inc., for
property located at 4501 Bay
City Road from Residential B zoning to Regional
Commercial.
Mr. Poprave oriented them to the
site. Rockwell Drive is to the east. It currently has a rental property on the
lot. Staff recommends denial due to the fact that it is inconsistent with the Master
Plan and Zoning Ordinance.
Mr. Senesac stated that he reviewed the pros
and cons and he supports the staff to not rezone. Ms. Hanna seconds that thought. Ms. Brown agrees with them.
Motion by Senesac, seconded by Hanna, to
recommend to City Council approval of Zoning Petition No. 555:
Mr. Mead feels that as it is right now the
business is doing what it is designed to do as it stands now, he agrees with Ray
and will vote against it.
Ms. Svenson doesn’t see a point to change
it unless there is more developed later.
Mr.
Eyre doesn’t see a need for it at this point.

November 25, 2008 is the next regularly scheduled Planning
Commission meeting.
December 9th is the only meeting date in December.
Annual Training Workshop – Planning is underway for the commission’s
annual training workshop. Suggested
dates include Saturday January 31, 2009 and Saturday February 7, 2009. Topics being considered include the review of
recent Conditional Zoning petitions and their implementation, the city’s GIS
system as well as an advanced Zoning Board of Appeals training
opportunity.
