All resolutions marked with an asterisk are considered to be routine and will be enacted by one motion. There will be no separate consideration of these items unless a Council member or citizen so requests during the discussion stage of the “Motion to adopt the Consent Agenda as indicated”. If there is even a single request the item will be removed from the consent agenda without further motion and considered in its listed sequence in regular fashion.

APPROVAL OF MINUTES:

2. Zoning Petition No. 480 to rezone property on the south side of Isabella Street (M-20) west of Vance Road from Residential A-1 and Agricultural to Business B-2. (Also see material sent in December 3 agenda packet.) LYNCH

ORDINANCE AMENDMENTS:

3. First reading to an ordinance to amend Chapter 2, Article XIII, of the City Code of Ordinances to provide a Payment in Lieu of Taxes (PILOT) for Chippewassee Court Phase I, a proposed 11-unit residential housing project located west of Smith Street on the north side of Isabella Road in the City of Midland. RESOLUTIONS:

4. Conducting interviews of applicants and making appointment to:

a. West Main Street Historic District Commission. DUSO

b. Saginaw-Midland Municipal Water Supply System Board. DUSO

5. Extending the trial period of Traffic Control Orders and making them permanent: MCMANUS

* a. S-01-04 – establishes that Scenic Drive yield to Stillwater Lane

* b. S-01-05 – establishes that Schade Drive West stop for W. Wackerly Street

* 6. Making Traffic Control Order P-01-09 permanent – that parking be prohibited on Madison Street, Burch Street, Soper Street and Forest Street. MCMANUS

* 7. Accepting a Revised Easement Agreement from Nicolaos A. Rapanos, Elaine D. Rapanos, Jason L. Rapanos and Christine N. Rapanos for a sanitary sewer pump station on the north side of E. Ashman Street east of Waldo Avenue. MCMANUS

* 8. Changing the name of Wheeler Park to Shipps Family Park. MCGUIRE

* 9. Authorizing the sale of surplus computer items at public auction on January 26, 2002. MEYER

10. Considering purchases and contracts:

* a. Authorizing payment to the appraisal firm of Terzo & Bologna, Inc. for contracted appraisal services in the defense of the assessment appeal by The Dow Chemical Company regarding three separate parcels. BRANSON

b. Authorizing payment relating to the City’s defense in the Dow Corning Corporation and The Dow Chemical Company’s appeal to the Michigan Tax Tribunal: BRANSON

* 1. Miller, Canfield, Paddock & Stone for contracted legal services.

* 2. Max Derbes & Associates and Baker & O’Brien for contracted appraisal services.

* 11. Setting a public hearing to amend the City of Midland’s 2001-02 budgets and financial working plans to recognize a decrease in the estimated amount of revenue from investment earnings (1/28). FISHER
