            All resolutions marked with an asterisk are considered to be routine and will be enacted by one motion.  There will be no separate consideration of these items unless a Council member or citizen so requests during the discussion stage of the “Motion to adopt the Consent Agenda as indicated”.  If there is even a single request the item will be removed from the consent agenda without further motion and considered in its listed sequence in regular fashion.

            5.         Request from Dow Corning Corporation for an Industrial Facilities Exemption Certificate within the Dow Corning Corporation’s Industrial Development District relating to machinery and equipment (Also see material sent in August 11 agenda packet.)  ELBERS

 


            6.         2003 Isabella Sanitary Sewer Improvement Special Assessment District Special Assessment Roll (Also see material sent in August 25 agenda packet.)  ELBERS

 

            7.         Zoning Petition No. 502 to rezone property west of Stark Road, north of East Saginaw Road, at 1351 East Saginaw Road from Township Zoning to Office Service-2 (Also see material sent in August 11 agenda packet.)  LYNCH

 

            8.         Zoning Petition No. 503 to rezone property east of Stark Road, north of East Saginaw Road, at 1649 East Saginaw Road from Township Zoning to Business B-2 and Residential A-1 (Also see material sent in August 11 agenda packet.)  LYNCH

            9.         2003 Cub Street Improvement Special Assessment District:

                        a.         Determining necessity and directing the City Assessor to prepare an assessment roll.  (Public Hearing of Necessity was held August 11; action was tabled until 9/8/03.)  MCMANUS

                        b.         Accepting special assessment roll and setting public hearing on the roll (9/29).  ELBERS

 

          10.         2003 Dublin Sanitary Sewer Improvement Special Assessment District:

                        a.         Determining necessity and directing the City Assessor to prepare an assessment roll.  (Public Hearing of Necessity was held August 11; action was tabled until 9/8/03.)  MCMANUS

                        b.         Accepting special assessment roll and setting public hearing on the roll (9/29).  ELBERS

 

          11.         Approving extension of time for completion of sidewalk:  LYNCH

                        a.         Scenic Estates Subdivision No. 4 (This item was on August 25 Council agenda; action was postponed until 9/8)

*                      a.         P-03-08 – that parking shall be prohibited on Wheeler Street from 100’ west of Claremont Street to Foster Road.

*                      b.         S-03-07 – that “Stop Here on Red” control be provided on Carpenter Street between Jerome Street and Suncrist Street at stop bars located 75’ east and west of the center of the Carpenter School crosswalk.

 

          13.         Consideration of purchases and contracts:

          14.         Setting public hearings:

*                      a.         Revised Brownfield Redevelopment Plan for Dow Corning Corporation (10/13).  TOMION

*                      b.         Zoning Text Amendment No. 140a to amend the Zoning Ordinance by  amending Article II to define correctional facility; by amending Article XXX to provide parking standards for correctional facility; and by amending Article XI to list correctional facility as a use permitted via special use permit in the C – Community Zone (9/29).  LYNCH

*                      c.         Budget Amendment for 2004 for encumbrances rolled forward (9/29).  KEENAN

 

          15.         Adjourning to a closed session to discuss pending litigation, specifically Dow Corning Corporation vs. City of Midland and The Dow Chemical Company vs. City of Midland, and to discuss a written opinion by the Midland City Attorney.  BRANSON
