All resolutions marked with an asterisk are considered to be routine and will be enacted by one motion. There will be no separate consideration of these items unless a Council member or citizen so requests during the discussion stage of the “Motion to adopt the Consent Agenda as indicated”. If there is even a single request the item will be removed from the consent agenda without further motion and considered in its listed sequence in regular fashion.

APPROVAL OF MINUTES:

* 1. Approve minutes of August 9 special and regular City Council meetings. TISDALE

ORDINANCE AMENDMENTS:

2. First reading of an amendment of the Soil Erosion and Sedimentation Control Ordinance and Section 34-5, Civil Infractions. LYNCH

RESOLUTIONS:

3. Approving Site Plan No. 237 – a revised site plan for expansion of the Midland Soccer Club complex on 28.5 acres south of Joseph Drive and north of Diamond Drive, east of Midfield Lane. LYNCH

4. New Civic Arena:

a. Awarding bid for the sale of $6.5 million in bonds. KEENAN

b. Accepting deed for the property. MCGUIRE

c. Authorizing execution of construction contract. MCGUIRE

5. Directing City staff to prepare and distribute Request for Proposals and directing City Attorney to prepare lease contracts associated with leasing and placement of commercial antennas on the Jefferson Water Tower. BUSH

* 6. Receiving the 2003-04 Library Board Annual Report. BARNARD

7. Making Traffic Control Orders permanent: MCMANUS

* a. P-04-11 – that parking shall be prohibited on both sides of Bayliss Street from Barth Street to Lyon Road.

* b. P-04-13 – that parking shall be prohibited on both sides of Waldo Avenue from Eastlawn Drive to 200’ south.

* 8. Accepting transfer of jurisdiction of Jefferson Avenue from 2886’ north of Wackerly Street to Letts Road from the Midland County Road Commission. MCMANUS

* 9. Authorizing staff to modify and amend the established Final Pay Deferral Plan, to allow participation of represented employees upon establishment of the required Letter of Agreement between the union(s) and the City. SPEESE

10. Consideration of purchases and contracts:

* a. Occupational Health Nurse Services. SPEESE

* b. 2004 St. Charles & Whitman Drive Reconstruction; Contract No. 2. MCMANUS

* c. MDOT Contract No. 04-5364 for street widening on Jerome Street (M-20) between Indian and Buttles Streets. MCMANUS

* d. Lease of Wheel Loader – Landfill. BUSH

11. Adjourning to a closed session to discuss strategy in connection with negotiations

of collective bargaining agreements. TOMION
