            All resolutions marked with an asterisk are considered to be routine and will be enacted by one motion.  There will be no separate consideration of these items unless a Council member or citizen so requests during the discussion stage of the “Motion to adopt the Consent Agenda as indicated”.  If there is even a single request the item will be removed from the consent agenda without further motion and considered in its listed sequence in regular fashion.

APPROVAL OF MINUTES:

1.                  *  Approve minutes of the September 24 regular City Council meeting.  TISDALE

2.                  Zoning Text Amendment No. 155 - to amend the City of Midland Zoning Ordinance to change the method of measuring the setback from an unobstructed sight area under specified conditions (also see material sent in the September 17 agenda packet).  KAYE

3.                  Request from The Dow Chemical Company for an Industrial Facilities Tax Exemption Certificate within The Dow Chemical Company Plant Rehabilitation District No. 1 (also see material sent in the September 24 agenda packet).  DUFORD

6.                  Accepting a grant from the Midland Area Community Foundation for updating the play equipment in twelve neighborhood parks.  MURPHY

7.                  *  Receiving and filing the City and County Joint Building Authority Audit for the year ended June 30, 2012.  KEENAN

8.                  *  Approving the annexation request from Timothy A. Lyons for property located at 5600 Falcon Way.  KAYE

9.                  *  Approving the request to circulate the City of Midland Master Plan draft for review by the public, neighboring jurisdictions and other entities and hold an open house.  KAYE

10.              *  Accepting the resignation of Zachary Prior from the Downtown Development Authority board.  TISDALE

11.              *  Authorizing the sale of a surplus tractor.  MURPHY

12.              *  Approving request from the Girl Scouts Heart of Michigan to conduct an event on October 20 utilizing the public right-of-way.  MCMANUS

13.              *  Approving request from the Tri City Cyclists to conduct a Cyclocross bike race event on Sunday, December 9.  MCMANUS

Considering purchases and contracts:

14.              *  Increase Purchase Order for General Engineering Consulting - Landfill.  BUSH

15.              *  Increase Purchase Order for sand for daily waste coverage - Landfill.  BUSH

16.              *  Diesel Fuel Purchase of September 27 (4/5 vote required).  MURPHY

17.              *  Replacement Trees in the city rights-of-way.  MURPHY

Setting a public hearing:

18.              *  Amendment to the 2012/13 budget of the Grace A. Dow Memorial Library to recognize $3,000,000 from The Herbert H. and Grace A. Dow Foundation to fund infrastructure and interior improvements at the Library (10/29).  BARNARD

19.              *  Amendment to the 2012/13 General Fund budget to recognize $68,400 of additional revenue from the Midland Area Community Foundation grant to purchase and install playground equipment in neighborhood parks (10/29).  MURPHY

20.              *  Amendment to the 2012/13 Water Enterprise Fund budget to recognize additional revenues of $75,720 for Filter Clear Well Repairs at the Water Treatment Plant (10/29).  BUSH

21.              *  Zoning Petition No. 581 - to amend the City of Midland zoning map by rezoning the property located at 1334 Stark Road from Township zoning to Residential A-1 zoning (11/12).  KAYE

22.              *  Zoning Petition No. 582 - to amend the City of Midland zoning map by rezoning the property located at 9203 Eastman Avenue from Township zoning to Residential B zoning (11/12).  KAYE

23.              *  Zoning Petition No. 583 - to amend the City of Midland zoning map by rezoning the property located at 7730 West Wackerly Street from Township zoning to Industrial A zoning (11/12).  KAYE

24.              *  Conditional Use Permit No. 42 - to consider a request of North-Point Building and Remodeling, Inc. for a 14 unit residential town house development located at 2711, 2721, 2801 and 2811 West Wackerly Street in an Office Service zoning district on 1.69 acres (11/12).  KAYE

25.              *  Zoning Text Amendment No. 156 - to amend the City of Midland Zoning Ordinance to amend and add section 8.07 E to the Zoning Ordinance to add sign regulations for the Downtown Northside Overlay district (11/12).  KAYE
