MIDLAND CITY COUNCIL

 

A regular meeting of the City Council was held on Monday, June 25, 2001.  Mayor Black presided.

 

Council members present:

Held a public hearing and approved an Industrial Facilities Exemption Certificate for the Dow Corning Corporation.

 

Held a public hearing of necessity for the 2001 Mac Street Improvement project and approved the same.

 

Accepted the special assessment roll for the “2001 Mac Street Improvement Special Assessment District” and set a public hearing on the roll for July 9, 2001, at 7:00 p.m.

 

Held a public hearing of necessity for the 2001 Perrine Sanitary Sewer Improvement project and approved the same.

 

Accepted the special assessment roll for the “2001 Perrine Sanitary Sewer Improvement Special Assessment District” and set a public hearing on the roll for July 9, 2001, at 7:00 p.m.

 

Held a public hearing of necessity for the 2001 Shreeve Street Improvement project and approved the same.

 

Accepted the special assessment roll for the “2001 Shreeve Street Improvement Special Assessment District” and set a public hearing on the roll for July 9, 2001, at 7:00 p.m.

 

Held a second reading and approved an amendment to Chapter 29, Stormwater Runoff Regulation and Control.

 

Held a first reading on a proposed amendment to Chapter 22, Article II of the Code of Ordinances to add a new “Division 1. In General,” and “Division 2. Downtown Streetscape” and establish the Downtown Development Authority District Public Sidewalk Use Policy.

 

Received and ordered filed the staff report on Sycamore Trees.

 

Approved the Preliminary Plat of Hearthstone Estates No. 3.

 

Extended pricing from various suppliers of construction materials until December 31, 2001.

 

Extended pricing for contracted sidewalk construction from Sugar Construction until December 31, 2001.

 

Approved the “Short-Term Overflow Storage Basin” Agreement and grant of easement between the City of Midland and The Dow Chemical Company.

 

Approved the purchase of insurance coverage for the 2001-02 Fiscal Year.  (Yeas:  Black, Currie, McKeag   Nays:  Coppage)

 

Approved the purchase agreement for the sale of a C.H.O.I.C.E. house at 205 Bradley Court.

 

Approved the purchase agreement for the sale of a C.H.O.I.C.E.     house at 217 Bradley Court.

 

Approved the purchase agreement for the sale of a house at 3520 West Wackerly Street.

 

Approved the negotiated contract settlement between the City of Midland and the Police Command Officers.

 

Authorized execution of a contract with Johnston Contracting, Inc. of Midland, Michigan, for the “2001 Patrick Force Main Sewer; Contract No. 26”, in the amount of $141,128.

 

Authorized purchase order to Standby Power, Inc. of Redford, Michigan, for the purchase and installation of two back-up generators in the aggregate amount of $50,599.

 

Authorized final payment to Miller, Canfield, Paddock & Stone for contracted legal services relating to the Bay City Road Interchange Project in the amount of $10,587.73.

 

Authorized payment to Plante and Moran, LLP, for accounting services related to the City’s defense in The Dow Chemical Company tax appeal in an amount not to exceed $50,000.

 

Authorized payment to Plante and Moran, LLP, for accounting services related to the City’s defense in the Dow Corning Corporation’s tax appeal in an amount not to exceed $196,000.

 

Authorized execution of an agreement with the Midland Economic Development Council for economic development services for July 1, 2001, through June 30, 2002, at a cost not to exceed $85,000.

 

Set a public hearing for July 23, 2001, at 7:00 p.m. on Zoning Petition No. 477 – rezoning property at 3103 West Wackerly Street from Residential A-1 to Office-Service 2.

 

Set a public hearing for July 23, 2001, at 7:00 p.m. on Zoning Petition No. 478 – rezoning property between Bay City Road and Fisher Road west of US-10 Expressway from Agricultural and Business B-2 to Business C and Industrial A.

 

Held discussion and approved resolution opposing House Bill No. 4960 that codifies municipal sewer backup liability as established by the Michigan Court of Appeals in C, S & P v. City of Midland.
