A regular meeting of the City Council was held on Monday, January 13, 2003.  Mayor Black presided with all Council members present.


Held a public hearing and approved Zoning Petition No. 497 – rezoning property north of Oakbrook Court, east of Jefferson Avenue from Township Zoning to Residential A-1.


Held a public hearing and approved Zoning Petition No. 498 – rezoning property west of Perrine Road, south of Letts Street from Township Zoning to Residential A-1.


Held a public hearing and approved Zoning Petition No. 499 – rezoning property west of Abbott Road, north of Betsey Drive, south of Alta Court from Residential A-2 to Residential A-4.


Gave first reading to an ordinance to provide Payment In Lieu Of Taxes for Chippewassee Court Phase II.  (Yeas:  Black, Currie, McKeag, Wazbinski   Nays:  None   Abstained:  Griggs)


Approved a two-year time extension for the Preliminary Plat of Bogel’s Urban Subdivision No. 2.


Made the following Traffic Control Orders permanent:

      P-02-10    Parking shall be prohibited on Jefferson Avenue from Wheeler Street to Wackerly Street.

      R-02-09   Speed limit on James Savage Road between Saginaw Road and Rockwell Drive be posted at 45 m.p.h.

      S-02-12    Intersection of Scenic Drive and Wildflower Lane shall be a four-way stop.

      S-02-13    Travis Court shall yield to Whitewood Drive.

      S-02-14    Barto Street shall stop for Campau Drive.

      S-02-15    Norwood Drive shall stop for Campau Drive.


Accepted Quitclaim Deed and Easement Agreement for the right of way of future Sugnet Road west from Main Street to make this a public street and for future public utilities.


Accepted Warranty Deed for the turn-around at the west end of Terra Drive to make this a public street.


Recommended approval to the Michigan State Liquor Control Commission on a request from B.B. Banuck’s (Alex’s Greek Kitchen) for a new on-premises banquet facility permit with entertainment permit for the business located at 5103 Eastman Avenue, Suite 167.


Received and ordered filed the Annual Financial Statement and Auditor’s Report for the City and County of Midland Joint Building Authority for the fiscal year ended June 30, 2002.


Authorized execution of labor contract between the City of Midland and the Midland Municipal Employees Association.


Authorized execution of HVAC Maintenance Agreement for services at Riverside Place, Washington Woods and the Grace A. Dow Memorial Library to J.E. Johnson Contracting, Inc. for an annual amount of $83,442.87 plus a 2.5% annual increase for up to a 5-year period.


Awarded bid for furnishing and loading onto City trucks Bituminous Mixture #2 to Pyramid Paving at the unit price of $23.50 per ton.


Awarded bid for annual supply of liquid calcium chloride to Liquid Calcium Chloride Sales of Kawkawlin, Michigan at a cost of $0.227 per gallon for 30% and $0.308 per gallon for furnishing 38%.


Awarded bid for annual supply of concrete and related materials to Allied Concrete Products, Inc. of Midland, Michigan at the unit prices submitted in their November 26, 2002 Bid #2636 response.


Authorized an increase of $775,000 to the November 11, 2002 purchase order for contracted legal services to Braun, Kendrick, Finkbeiner, P.L.C., Westrate and Holmstrom, P. C. and Spiegel & McDiarmid in connection to the MCV tax appeal.


Authorized issuance of purchase orders for professional services regarding the Design and Construction Proposal for Storm Water Improvements to Rama Rao and Alfred of Detroit, Michigan in the amount of $20,000 and to Hubbell, Roth and Clark of Bloomfield, Michigan in the amount of $45,000.


Authorized Change Order in the amount of $30,00 for the Flow Monitoring Study portion of an existing purchase order with Hubbell, Roth & Clark.


Authorized execution of an agreement committing the City to participate in the M.Co.Net fiber network.


Set a special joint meeting with the City Council and the Parks and Recreation Commission for Monday, January 27, 2003, at 6:00 p.m.
