MIDLAND CITY COUNCIL

 

A regular meeting of the City Council was held on Monday, September 8, 2003.  Mayor Black presided with all Council members present.

 

Proclaimed September 21-27, 2003, as Excellence in Skilled Nursing Care Week in Midland.

 

Heard presentation on the Midyear Safety Progress Report.

 

Recognized Dennis Lauer of the Engineering Department, as recipient of the seventh annual City Manager’s Safety Leadership Award.

 

Held a public hearing and authorized execution of contract with Midland County Sportsman’s Club to hold Gun Show at the Midland Civic Arena in 2004.

 

Held a public hearing and approved an industrial facilities exemption certificate application for the Dow Corning Corporation.  (Yeas:  Black, Currie, Griggs, McKeag   Nays:  None   Abstained:  Wazbinski)

 

Held a public hearing and approved the special assessment roll for the 2003 Isabella Sanitary Sewer Improvement Special Assessment District.

 

Held a public hearing and approved Zoning Petition No. 502 – rezoning property west of Stark Road, north of East Saginaw Road, at 1351 East Saginaw Road from Township Zoning to Residential A-1.  (Yeas:  Black, Currie, Griggs, Wazbinski   Nays:  McKeag)

 

Held a public hearing and approved Zoning Petition No. 503 – rezoning property east of Stark Road, north of East Saginaw Road, at 1649 East Saginaw Road from Township Zoning to Residential A-1.  (Yeas:  Black, Currie, Wazbinski   Nays:  Griggs, McKeag)

 

Necessity for the 2003 Cub Street Improvement project was denied by the following vote:  Yeas:  Wazbinski    Nays:  Black, Currie, Griggs, McKeag.

 

Determined the necessity for the 2003 Dublin Sanitary Sewer Improvement project. 

 

Accepted the special assessment roll for the “2003 Dublin Sanitary Sewer Improvement Special Assessment District” and set a public hearing on said roll for September 29, 2003, at 7:00 p.m.

 

Approved extension of time for completion of sidewalk in Scenic Estates Subdivision No. 4 until April 1, 2004.  (Yeas:  Griggs, McKeag, Wazbinski    Nays:  Black, Currie)

 

Approved extension of time for completion of sidewalk in Foster Woods Subdivision until September 10, 2005.

 

Approved extension of time for completion of sidewalk in Foster Woods Subdivision No. 2 until September 10, 2005.

 

Approved extension of time for completion of sidewalk in Hearthstone Estates Subdivision No. 3 until September 18, 2004.

 

Made the following Traffic Control Orders permanent:

       P-03-08    Established that parking shall be prohibited on Wheeler Street from 100’ west of Claremont Street to Foster Road.

       S-03-07    Established that “Stop Here On Red” control be provided on Carpenter Street between Jerome Street and Suncrist Street at stop bars located 75’ east and west of the center of the Carpenter School crosswalk.

 

Waived competitive bids and authorized issuance of purchase order to Valley Library Consortium of Saginaw, Michigan, for on-line automation services for the 2003-04 fiscal year, in an amount not to exceed $110,000.

 

Waived competitive bids and authorized issuance of purchase order to Mideastern Michigan Library Cooperative for library services for the 2003-04 fiscal year, in an amount not to exceed $38,000.

 

Authorized issuance of purchase order to MidMichigan Urgent Care Center of Midland, Michigan, for occupational health nurse services for the 2003-04 fiscal year, in an amount not to exceed $26,832.

 

Authorized execution of Standard Wholesale Raw Water Service Agreements between the Saginaw-Midland Municipal Water Supply Corporation and the City of AuGres, City of Omer, Linwood Metropolitan Water District and Sims-Whitney Utilities Authority.

 

Authorized issuance of purchase order to Enviro Group, Inc. of Greenwood, Indiana, for Landfill Alternative Cover Spray System, in the amount of $38,750.

 

Extended original proposal and authorized issuance of purchase order to Doc Heinz Contracting of Saginaw, Michigan, for hauling sand to the Landfill, in the amount of $41,730.

 

Authorized execution of Change Orders #3971-9, #3971-12, #3971-14, #3971-18 and #3917-19 for a total amount of $10,160, amending the contract with Sugar Construction for the St. Charles Softball Complex Phase II project.

 

Authorized issuance of purchase orders to Graff Truck Center of Saginaw, Michigan, for two tilt cab dump trucks, in the net amount of $50,524 and to Martin Chevrolet Sales, Inc. of Saginaw, Michigan, for the purchase of four 10,000 GVW service trucks, in the net amount of $103,081.

 

Authorized issuance of purchase order to Wieland Sales of Bay City, Michigan, for the purchase of one snow plow truck and one 25,000 GVW flatbed truck, in the net amount of $108,781.16.

 

Authorized payment to Michigan Municipal League Liability and Property Pool in the amount of $50,000 in full settlement of claim for insurance deductibles.

 

Set a public hearing for October 13, 2003, at 7:00 p.m. on a proposed amendment to the Dow Corning Corporation Brownfield Redevelopment Site Plan No. 1.

 

Set a public hearing for September 29, 2003, at 7:00 p.m. on Zoning Text Amendment No. 140a. – to provide parking standards for correctional facility and to list correctional facility as a use permitted via special use permit in the C – Community Zone.

 

Set a public hearing for September 29, 2003, at 7:00 p.m. on a proposed amendment to the 2003-04 City budgets and financial working plans.

 

Approved request to convene to a closed session to discuss a written opinion by the City Attorney.  (Roll Call Vote   Yeas: Black, Currie, Griggs, McKeag, Wazbinski  Nays:  None)

 

Reconvened to an open session.

 

Approved settlement to Chris Cohoon in the amount of $50,000.

 

Approved request to adjourn to a closed session to discuss pending litigation.  (Roll Call Vote  Yeas:  Black, Currie, Griggs, McKeag    Nays:  None   Abstained:  Wazbinski)
