A regular meeting of the City Council was held on Monday, September 29, 2003.  Mayor Black presided with all Council members present.


Proclaimed October 5 – 11, 2003 as Fire Prevention Week in the City of Midland.


Held a public hearing and approved Zoning Petition No. 501 to rezone property west of Stark Road on the north side of East Saginaw Road at 1367 and 1419 from township zoning to Residential A-1.  (Yeas:  Black, Currie, Wazbinski   Nays:  Griggs, McKeag)


Held a public hearing and approved the special assessment roll for the “2003 Dublin Sanitary Sewer Improvement Special Assessment District”. 


Held a public hearing and approved Zoning Text Amendment No. 140a by amending Article II to define correctional facility; by amending Article XXX to provide parking standards for correctional facility; and by amending Article XI to list correctional facility as a use permitted via special use permit in the C-Community Zone.


Held a public hearing and amended the 2003-04 City budgets and financial working plans to provide funding for June 30, 2003 encumbrances.


Approved Site Plan No. 220 for Taco Bell Restaurant to be located at 1820 South Saginaw Road.


Approved Site Plan No. 230 for a 14,036 square foot office and research laboratory on the northwest corner of Ridgecrest Drive and Ridgewood Drive for Aegis Environments.  (Yeas:  Currie, Griggs, McKeag, Wazbinski   Nays:  None   Abstained:  Black)


Approved Site Plan No. 231 for a 31,000 square foot two story office building on the east side of Eastman Avenue, south of Dilloway Drive.  (Yeas:  Black, Griggs, McKeag, Wazbinski  Nays:  Currie)


Approved a two year extension of time for completion of sidewalk in Sterling Park Estates Subdivision No. 10.


Approved purchase agreement for the sale of a CHOICE house at 330 Cottonwood Street.


Accepted a Warranty Deed for right of way required to re-align the intersection of Waldo Court at Saginaw Road.


Accepted an Easement Agreement for placement of public water mains across Home Depot development on Joe Mann Boulevard.


Made the following Traffic Control Orders permanent:

       P-03-10    Established that parking shall be prohibited on Schade Drive from Wackerly Street to 50’ south of Wackerly Street.

       P-03-11    Established that parking shall be prohibited on both sides of Dartmouth Street from E. Ashman Street to 25’ north of E. Ashman Street and from E. Ashman Street to 25’ south of E. Ashman Street.

       S-03-08    Established that Diamond Drive shall stop for Midfield Lane and Midfield Lane stop for Diamond Drive, thus making a three-way stop.


Approved Library Patron Rules of Conduct and directed staff to post the “Rules of Conduct” in the Grace A. Dow Memorial Library.


Approved changes to the Cemetery Rules.


Established the 2004 regular meeting dates for the Midland City Council.


Authorized issuance of purchase order for health insurance consulting services from Saginaw Bay Underwriters of Saginaw, Michigan in the amount of $50,642 for a period of October 1, 2003 through September 30, 2004.


Authorized execution of Agreement Regarding Common Representation of the Midland County Road Commission and the City of Midland and Agreement between the Midland County Road Commission and the City Regarding the Extension of Airport Road and authorized payment to Miller, Canfield, Paddock & Stone for contracted legal services relating to this matter in an amount not to exceed $40,000.


Authorized execution of Change Order No. 2 in the amount of $15,860 for the 2003 Jack Barstow Airport Runway Safety Area Grading, Tree Removal/Trimming, and Drainage Improvements; Contract No. 18 with Porath Contractors Inc. of Houghton Lake, Michigan.


Authorized execution of Change Order No. 1 in the amount of $13,000 for the George Street Storm Sewer System Improvement – Design Engineering Services contract with Hubbell, Roth and Clark, Inc. of Bloomfield Hills, Michigan.


Waived competitive bids and authorized issuance of a purchase order to Doc Heinz Contracting of Saginaw, Michigan for $40,260 for purchase and hauling of topsoil to the City of Midland Landfill.


Authorized issuance of purchase order to Johnston Contracting of Midland, Michigan for Landfill Compost Pad Construction; Bid No. 2711, in the amount of $213,213.


Authorized issuance of purchase orders for Mechanical Joint Fittings from East Jordan Iron Works of East Jordan, Michigan in the amount of $30,108.22, from Etna Supply Company of Grand Rapids, Michigan in the amount of $33,398.70 and Municipal Supply Company of Portland, Michigan in the amount of $3,346.20.


Authorized change order to existing purchase order to Synagro of Sparta, Michigan for Digester Tank Cleaning Service at the Wastewater Treatment Plant in the amount of $10,400, bringing the total purchase order to $30,400.
