OFFICIAL SYNOPSIS

MIDLAND CITY COUNCIL

 

A regular meeting of the City Council was held on Monday, March 8, 2004.  Mayor Black presided with all Councilmen present.

 

Recognized Police Sergeant George Hutter upon his selection as the 2003 Carl & Esther Gerstacker Law Enforcement Officer of the Year Award recipient.

 

Held public hearing and approved Zoning Petition No. 505 – rezoning property at 1610 Bookness Street from Residential A-4 to Office Service 2.  (Yeas:  McKeag, Myers, Rokosz    Nays:  Black, Johnson)

 

Held public hearing and approved a 2003-04 General Fund Budget amendment to recognize as revenue a grant from the Midland Area Community Foundation for $70,000 and recognize an unanticipated expenditure of $70,000 for the design and construction of a dock near the Tridge.

 

Held a public hearing and approved a 2003-04 General Fund Budget amendment to recognize as revenue a grant from the Rollin M. Gerstacker Foundation for $200,000 and recognized an unanticipated expenditure of $200,000 for the construction of a Sprayground at Longview School.

 

Held second reading and approved an ordinance amending Civic Arena Fees.

 

Held second reading and approved an ordinance amending Golf Course Fees.

 

Held second reading and approved an ordinance amending Swimming Pool Fees.

 

Held second reading and approved an ordinance amending General Recreation Fees.

 

Directed the West Main Street Historic District Commission to meet with the State Historic Preservation Office to discuss delegation of authority for issuance of certificates of appropriateness. 

 

Approved Site Plan No. 236 – revised Forestridge Condominiums.

 

Directed City Manager to prepare a report on the 2004 Sidewalk Improvement Program.

 

Approved medallion designs and installation of four medallions on Eastman Avenue/US-10 overpass.

 

Authorized City Attorney to settle small damage claims in an amount not to exceed $5,000 per claim.

 

Accepted staff report regarding sidewalk snow clearing.

 

Named City Manager Karl S. Tomion as Transportation Coordinator and stated the City’s intentions to apply for Federal and State Financial Assistance.

 

Authorized City Manager Karl S. Tomion to enter into and execute all contracts of $20,000 or less with the Michigan Department of Transportation.

 

Rejected bids received for Golf Course Maintenance Services, Bid No. 2733.

 

Approved revised Membership Agreement with the Michigan Municipal League Unemployment Compensation Group Account.

 

Authorized payment to Max Derbes & Associates and Baker & O’Brien for appraisal services relating to the Dow Corning and The Dow Chemical Company’s tax appeals in an amount not to exceed $6,790,000.

 

Authorized issuance of purchase order to KME Fire Apparatus of Nesquehoning, Pennsylvania for the purchase of a Rescue/Pumper Unit in the net amount of $298,179.

 

Authorized issuance of purchase order to Saginaw Asphalt of Carrollton, Michigan for the annual purchase of approximately 1,500 tons of Bituminous Mixture #2 at a cost of $24.52 per ton.

 

Authorized issuance of purchase order to Fisher Sand & Gravel, Inc. of Midland, Michigan for the annual supply of concrete and related materials at the unit prices contained in their February 10, 2004 bid response.

 

Established the existence of City Street Lighting Upgrade Program with Consumers Energy and authorized the City Manager to proceed with the work.

 

Authorized execution of the City of Midland and the Midland Soccer Club Roadway Agreement.

 

Authorized execution of the City of Midland and Earl D. Bennett Construction, Inc. Infrastructure Agreement.

 

Set a public hearing for Monday, March 22, 2004 at 7:00 p.m. on a proposed amendment to the 2003-04 Library Budget to fund construction of a coffee bar.

 

Received proposed amendments to the MCTV Rules and Procedures and set a public hearing on said amendments for Monday, March 22, 2004 at 7:00 p.m.

 

Approved specific list of goals developed by City Council during two goal-setting sessions.

 

Approved request to adjourn to a closed session to discuss pending litigation.  (Yeas:  Johnson, McKeag, Myers, Rokosz   Nays:  None   Abstained:  Black)
