MIDLAND CITY COUNCIL

A regular meeting of the City Council was held on Monday, April 12, 2004. Mayor Black presided with all Councilmen present.

Held public hearing and denied Zoning Petition No. 506 – rezoning property at 4710 Eastman Avenue from Office Service 2 to Business B-1. (Yeas: None Nays: Black, Johnson, McKeag, Myers, Rokosz)

Held public hearing and approved an amendment to the 2003-04 Downtown Development Authority budget for spring 2004 planting season.

Received and ordered filed the City Manager’s 2004-05 Proposed Budget and set two public hearings on the budget, April 26, 2004, at 7:00 p.m. and May 10, 2004, at 7:00 p.m.

Authorized and directed City Clerk to publish notice of intent to issue bonds for the purpose of financing a portion of the cost of construction and equipping a new Civic Arena.

Approved Final Plat of Oakbrook Estates East Subdivision.

Made the following Traffic Control Order permanent:

S-03-13 Robinhood Terrace shall stop for Sugnet Road.

Accepted Easement Agreement from The Dow Chemical Company for George Street Drainage Basin Sewer project.

Accepted Easement Agreement from Consumers Energy for placement of a gas mainline on City property west of Eastman Avenue between Joe Mann Boulevard and Commerce Drive.

Accepted four new streets into the City of Midland Local Street System.

Received and referred a request to change the name of Diamond Drive to Soccer Drive on that segment from Jefferson Avenue to the intersection of the new Joseph Drive extension to the Planning Commission for consideration and recommendation.

Authorized transfer of budgetary funding for legal services regarding miscellaneous tax appeal cases and authorized payment to Miller, Canfield, Paddock & Stone for contracted legal services relating to the City’s defense in the Meijer tax appeal in an amount not to exceed $250,000.

Accepted staff report regarding the 2004 Midland Gun Show.

Authorized execution of contract with Terry Construction of Hamilton, Ohio for the “2004 Surface Treatment Program; Contract No. 4”, in the amount $143,245.70.

Authorized execution of contract with Huckins Contracting, Inc. of Beaverton, Michigan for the “2004 Ashman Water Main under US-10; Contract No. 11”, in the amount of $52,516.50.

Authorized execution of contract with Sova Excavating & Trucking, Inc. of Midland, Michigan for the “2004 Water Main Replacement Program; Contract No. 12”, in the amount of $159,341.94.

Authorized execution of contract with Johnston Contracting, Inc. of Midland, Michigan for the “2004 Eastman Curb and Sidewalk; Contract No. 21”, in the amount of $35,171.50.

Waived competitive bids and authorized the execution of contract with Raindrop Products to build a sprayground at Longview School, in the amount of $176,573.

Accepted gifts totaling $32,000 from the Midland Area Community Foundation and the Midland County Youth Action Council for a bicycle motocross track and authorized the execution of an agreement with National Bicycle League, Inc. for the construction of said track.

Authorized the execution of the Sixth Amendment to the City of Midland Sanitary Landfill Letter of Credit Agreement.

Authorized budget transfer in the amount of $33,063 and issuance of purchase order to R. W. Mercer of Saginaw, Michigan for the Landfill Fuel Storage System Upgrade, Bid No. 2751, in the amount of $45,063.

Authorized payment to Miller, Canfield, Paddock & Stone for contracted legal service relating to the Dow Corning Corporation’s and The Dow Chemical Company’s tax appeals, in a total amount not to exceed $4,805,000.

Set a public hearing on April 26, 2004, at 7:00 p.m. on a request from Case Systems, Inc. for an industrial facilities exemption certificate.

Set a public hearing of necessity on May 10, 2004, at 7:00 p.m. on the 2004 Sidewalk Improvement Program.

Set a public hearing on April 26, 2004, at 7:00 p.m. on a proposed amendment to the General Fund budget to increase revenues from an airport construction project refund.

Set a public hearing on April 26, 2004, at 7:00 p.m. on a proposed amendment to the 2003-04 General Fund budget to recognize and appropriate grant revenues.

Set a public hearing for April 26, 2004, at 7:00 p.m. on the proposed 2004-05 Community Development Block Grant Budget.

Set a public hearing for May 10, 2004, at 7:00 p.m. on Zoning Petition No. 507 – rezoning property at 7501 Perrine Road west of Perrine Road and Letts Street intersection from Township Zoning to Residential A-1.

Set a public hearing for May 10, 2004, at 7:00 p.m. on Zoning Petition No. 508 – rezoning property at 6700 North Saginaw Road, the northeast corner of the intersection of North Saginaw Road and Stark Road, from Township Zoning to Business B-2.

Set a public hearing for May 10, 2004, at 7:00 p.m. on Zoning Petition No. 509 – rezoning property at 4208 East Wheeler Street, east of Waldo Avenue, south side of East Wheeler Street intersection from Township Zoning to Agricultural.

Set a public hearing for May 10, 2004, at 7:00 p.m. on Zoning Petition No. 510 – rezoning property at 7505 Perrine Road west of Perrine Road and Letts Street intersection from Township Zoning to Residential A-1.

Set a public hearing for May 10, 2004, at 7:00 p.m. on Zoning Petition No. 511 – rezoning property at 7221 Jefferson Avenue, west side of Jefferson Avenue and north of Joe Mann Boulevard, from Township Zoning to Residential B.
