MIDLAND CITY COUNCIL

A regular meeting of the City Council was held on Monday, May 10, 2004. Mayor Black presided with all Councilmen present.

Held public hearing and determined the necessity for the 2004 Sidewalk Improvement Program and directed the City Assessor to prepare a special assessment roll for the “2004 Sidewalk Improvement Special Assessment District”.

Held a public hearing on the 2004-05 proposed budget and approved resolution amending the proposed budget to include proposed General Operating Fund budget cuts. (Yeas: Johnson, Myers, Rokosz Nays: Black, McKeag)

Held public hearing and approved Zoning Petition No. 507 – rezoning property at 7501 Perrine Road, west of Perrine Road and Letts Street intersection, from Township Zoning to Residential A-1.

Held public hearing and approved Zoning Petition No. 508 – rezoning property at 6700 North Saginaw Road, the northeast corner of the intersection of North Saginaw Road and Stark Road, from Township Zoning to Business B-2.

Held public hearing and approved Zoning Petition No. 509 – rezoning property at 4208 East Wheeler Street, east of Waldo Avenue, south side of East Wheeler Street Intersection, from Township Zoning to Agricultural.

Held public hearing and approved Zoning Petition No. 510 – rezoning property at 7505 Perrine Road, west of Perrine Road and Letts Street Intersection, from Township Zoning to Residential A-1.

Held public hearing and approved Zoning Petition No. 511 – rezoning property at 7221 Jefferson Avenue, west side of Jefferson Avenue and north of Joe Mann Boulevard, from Township Zoning to Residential B.

Held public hearing and approved General Fund Budget amendment to increase revenues by $32,000 and recognize expenditures of $32,000 for the construction of a Bicycle Motocross Track in Stratford Woods Park.

Received and filed staff report regarding holding a community meeting on dioxin soil testing in Midland.

Approved Site Plan No. 239 – Wal-Mart Gas Station.

Received and filed the Utilities Summary Report of the smoke testing phase of inflow and infiltration removal.

Authorized execution of contract with Sterling Excavation, Inc. of West Branch, Michigan for the “2004 Sewer Separation Program; Contract No. 10”, in the amount of $73,918.20.

Authorized execution of Lease Agreement with Midland Agricultural and Horticultural Society for land at Jack Barstow Airport.

Approved Statement of Investment Policy for the City of Midland Post-employment Health Care Fund.

Made permanent Traffic Control Order S-03-12 – Wildwood Street shall yield to Lamplighter Lane.

Approved request to hold an Artists Market in the Farmers Market facility from noon to 7:00 p.m. on June 10, July 8, and August 12, 2004.

Authorized budget transfer and approved Change Order No. 1 in the amount of $78,153.90 to increase the existing purchase order to William E. Lang Contracting of Beaverton, Michigan, for a final contract amount of $540,697.90 for Landfill Cells 1-13 Closure.

Authorized payment to Miller, Canfield, Paddock, & Stone for legal services and to Fishbeck, Thompson, Carr & Huber, Inc. for environmental consulting services relating to dioxin issues, in an amount not to exceed $180,000.

Set a public hearing on Monday, June 14, 2004, at 7:00 p.m. to consider changing the name of Diamond Drive to Soccer Drive.

Set a public hearing on Monday, June 14, 2004, at 7:00 p.m. on a proposed amendment to the General Fund budget to increase revenues in the amount of $11,923 from the Local Law Enforcement Block Grant and increase expenditures to purchase public safety equipment per grant guidelines.

Set a show cause hearing on Monday, June 28, 2004, at 7:00 p.m. on the revocation of liquor license held by Kokopelli’s.

Set a special meeting on June 28, 2004, at 6:00 p.m. for a pre-audit meeting with Plante and Moran, the City Council’s independent auditors.
