MIDLAND CITY COUNCIL

 

A regular meeting of the City Council was held on Monday, June 14, 2004.  Mayor Black presided.

 

Councilman present:

Proclaimed the week of June 20-27, 2004, as Amateur Radio Week in Midland.

 

Adopted the Parks and Recreation Master Plan.

 

Approved request to change the name of Diamond Drive to Soccer Drive.

 

Held public hearing and approved amendment to 2003-04 General Fund budget to increase revenue in the amount of $11,923 to recognize funds received from the Local Law Enforcement Block Grant.

 

Authorized issuance of purchase order to Kustom Signals, Inc. for the purchase of four (4) Digital In-Car Video Systems in the amount of $24,882.50.

 

Held public hearing and approved amendment to the 2003-04 General Fund budget to increase revenues in the amount of $13,323 to recognize grants and increase Police Department expenditures for purchase of DNA Sample Kits.

 

Held first reading of an amendment to the City of Midland Water Ordinance.

 

Held first reading of an amendment to the City of Midland Sewer Ordinance.

 

Revised the 2004 Construction Project Priorities List.

 

Authorized execution of Sidewalk Construction Agreements with property owners for the 2004 Sidewalk Improvement Program.

 

Authorized payment to the Midland County Road Commission in an amount up to $27,000 of County Road Millage Funds to acquire road right of way for Airport Road Extension Project.

 

Accepted Easement Agreement for the installation of water main across private property on Bay City Road.

 

Approved the placement of directional guide sign on W. Main Street at the intersection of W. Main Street and Orchard Drive to the Alden B. Dow Home and Studio.

 

Authorized preparation and distribution of an informational brochure regarding the road millage proposal on the November 2, 2004 General Election ballot.

 

Adopted the City of Midland Boards and Commissions Attendance Policy.  (Yeas:  Black, McKeag, Myers     Nays:  Rokosz)

 

Recommended the Cable Access Advisory Commission position currently held by Alex Berehula be considered vacant and instructed staff to advertise for applicants to fill the remainder of the term ending June 2006.

 

Approved levy and collection of taxes for the July 2004 tax roll for Midland Public Schools, Midland County Educational Service Agency, Bay City Public Schools, Bay-Arenac Intermediate Schools and Delta College.

 

Approved levy of taxes for the July 2004 tax roll for special assessments and accounts receivable.

 

Authorized execution of Subrecipient Agreements for award of Community Development Block Grant funds.

 

Approved annexation of 20 acres of vacant property located south of West Wackerly Street and east of Stark Road from Homer Township.

 

Approved request from K & D Espresso, Inc. to transfer ownership and location of a Class C Liquor License from Northwind Enterprises, Inc. (Kokopelli’s).

 

Postponed show cause hearing on Kokopelli’s liquor license scheduled for June 28, 2004 until September 13, 2004, if said license is activated prior to September 13, 2004, the show cause hearing shall be cancelled.

 

Received and filed the 2003 Annual Drinking Water Quality Report.

 

Made the following Traffic Control Orders permanent:

         P-04-03    Parking shall be permitted on the east side of Drake Street from Woodcrest School southerly property line to 50’ south.

         P-04-04    Parking shall be prohibited on both sides of Waldo Avenue from East Ashman Street to Eastlawn Drive.

         P-04-05    Parking shall be prohibited on the north side of Wheeler Street from 100’ west of Foster Road to 100’ east of Foster Road.

 

Authorized execution of contract with Sova & Sons Contracting, Inc. of Midland, Michigan for the “2004 Local Street Reconstruction, Phase II; Contract No. 7”, in the amount of $241,278.90.

 

Authorized execution of with Gerace Construction Company, Inc. of Midland, Michigan for the design/build services for Barstow Airport Terminal Building and accepted donations from various organizations.

 

Authorized execution of MDOT Contract No. 2004-0317 for the reconstruction of taxi streets at the Barstow Municipal Airport.

 

Authorized execution of MDOT Contract No. FM 56-1-C35 with Porath Contractors, Inc. for the reconstruction of taxi streets at the Barstow Municipal Airport.

 

Authorized execution of MDOT Contract No. 04-5239 for concrete resurfacing of the Sturgeon Avenue overpass of US-10.

 

Authorized execution of Change Order No. 3 to the 2003 Jack Barstow Airport Runway Safety Area Grading, Tree Removal/Trimming, and Drainage Improvements; Contract No. 18, in the amount of $12,310.

 

Authorized issuance of purchase order to L.J. Construction, Inc. of Clifford, Michigan for sidewalk replacement from July 2004 through December 2004, in an amount not to exceed $100,000.

 

Authorized execution of an agreement with Midland Economic Development Council for economic development services from July 1, 2004 through June 30, 2005, in an amount not to exceed $85,000.

 

Authorized issuance of purchase order to Carmeuse Lime of Detroit, Michigan to provide up to 1,250 tons annually of Calcium Oxide (Lime), at a total annual contract amount not to exceed $117,837.50.

 

Authorized issuance of purchase order to PVS Technologies, Inc. of Detroit, Michigan for the purchase of 250 tons each of Ferric Chloride for the Water and Wastewater Treatment Plants at a total aggregate annual contract amount not to exceed $117,815.

 

Accepted the special assessment roll for the “2004 Sidewalk Improvement Special Assessment District” and set a public hearing on said roll for July 12, 2004, at 7:00 p.m.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on a request from Electro Panel, Inc. for an Industrial Facilities Exemption Certificate.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposal to amend the 2003-04 General Fund budget to reflect grant funding received from the Michigan State Police Office of Highway Safety Planning.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on Special Use Permit No. 13 for an office building on 2.69 acres on Sugnet Road west of the Pere Marquette Rail Trail.

 

Accepted donation of up to $170,000 from the Friends of the Grace A. Dow Memorial Library to develop a Teen Room in the Library and set a public hearing on July 12, 2004, at 7:00 p.m. on a proposed amendment to the 2004-05 Grace A. Dow Memorial Library budget to recognize unanticipated revenues from contributions and to appropriate funds.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed 2003-04 Sanitary Landfill budget amendment in the amount of $50,000 for Hydrogeology Monitoring.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed 2003-04 General Fund budget amendment to increase expenditures by $200,000 for unanticipated expenses incurred in reviewing The Dow Chemical Company’s revised Scope of Work and the Interim Response Activities relating to the dioxin issues.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed amendment to the General Fund budget to increase 2003-04 expenditures by $230,000 in The Dow Chemical Company Tax Appeal Activity and $410,000 in the Dow Corning Corporation Tax Appeal Activity for unanticipated expenses incurred.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed amendment to the General Fund budget to decrease 2004-05 expenditures by $230,000 in The Dow Chemical Tax Appeal Activity and $410,000 in the Dow Corning Tax Appeal Activity.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed MCTV Fund Budget amendment to increase expenditures by $35,000 for the unanticipated expenses incurred in the cable franchise fee lawsuit.

 

Set a public hearing on June 28, 2004, at 7:00 p.m. on the proposed amendment to the 2004-05 Major Street Budget to participate with the Midland County Road Commission for Saginaw Road Reconstruction.
