MIDLAND CITY COUNCIL
A regular meeting of the City Council was held on Monday, November 23,
2009, at 7:00 p.m. Mayor Donker presided
with all Councilmen present.
Held first reading of an ordinance amending Section
21-71. Golf Course Fees. (Yeas: Adams, Donker, Gaynor,
Wazbinski Nays:
Johnson)
Received and filed the 2010-11 Budget Preparation
Schedule.
Authorized the execution of the issuance of General Obligation Limited
Tax Bond, Series 2010 in the principal sum of up to $10,000,000, to acquire and
construct 1) a Gas Collection and Control System at the Landfill, 2) a
Gas-to-Energy Facility at the Wastewater Treatment Plant, 3) a Compressor
Building at the Landfill, and 4) a Gas Pipeline from the Landfill to the
Gas-to-Energy Facility.
Authorized execution of construction contract with
Catskill Remedial Contracting Services, Inc. of Otsego, Michigan, for the
supply and installation of a gas collection and control system at the Landfill,
in the amount of $1,344,312.36.
Authorized execution of construction contract with
R. Roese Contracting Corporation, Inc. of Kawkawlin, Michigan, for the supply
and installation of a gas pipeline connecting the gas collection system at the
Landfill to the power generation facility at the Wastewater Treatment Plant, in
the amount of $608,815.75.
Authorized execution of construction contract with
The Christman Company of Lansing, Michigan, for construction of the
gas-to-energy plant and the landfill gas compressor building, in the amount of
$8,554,177.
Authorized increase to existing purchase order to CTI & Associates
to provide construction management and construction quality assurance for: 1) gas collection & control system
efforts, 2) gas pipeline, and 3) generator facility and compressor building, in
the amount of $576,011, bringing the total purchase order to $800,511.
Approved resolution notifying Charter
Communications of the City’s opposition to the changes in the location of
Midland’s cable access channels and requesting Charter to reconsider this
action.
Authorized updates to the City of Midland Section 125 Flexible Benefit
Plan Document to comply with all new IRS administrative regulations.
Received and filed the audit of the City and County of Midland Joint
Building Authority for the year ended June 30, 2009.
Accepted the 2008-09 Cable Access Advisory Commission Annual Report.
Received and filed review report on the boards and commissions
appointment process.
Reappointed Jenee Velasquez to the Brownfield
Redevelopment Financing Authority for a term to expire December 1, 2012.
Confirmed appointment of W. Douglas Thompson to the
Downtown Development Authority board.
Made Traffic Control Order P-09-05 permanent – parking shall be
prohibited on the north side of Reardon Street located from 240 feet east of
Ashman Street to a point 285 feet east of Ashman Street weekdays from 10:00
a.m. to 1:30 p.m. for the purpose of establishing a loading zone.
Waived bid requirement and approved purchase of 13,700 gallons of diesel
fuel from Hirschman Oil for $29,633.10 that was executed by the Purchasing
Agent on November 4, 2009.
Authorized issuance of purchase order to Miracle
Recreation of Okemos, Michigan, for playground equipment, in the amount of
$54,910.
Authorized increase to existing purchase order to Miller, Canfield,
Paddock and Stone, P.L.C. of Lansing, Michigan for legal assistance in
obtaining the City’s National Pollutant Discharge Elimination System (NPDES)
Permit, in the amount of $13,600, bringing the total purchase order to $33,600.
Set public hearing on Monday, December 21, 2009, at 7:00 p.m. on
Conditional Use Permit No. 36 – for a group daycare home (7-12 children)
located at 5805 W. Wackerly Street in a Residential A-1 zoning district on 2.67
acres.
Set public hearing on Monday, December 21, 2009, at 7:00 p.m. on Planned
Unit Development No. 16 – property west of Abbott Road north of Betsey Drive
and south of Alta Court – request to remove requirement to construct a 4’ wide
sidewalk on Kitty Hawk Circle.
