A regular meeting of the City Council was held on Monday, October 10,
2011, at 7:00 p.m. Mayor Donker presided.

Accepted staff presentation on the new City web portal called “Your City
Government….At a Glance”.
Held public hearing and approved revisions to the resolution previously
approved on the application from Dow AgroSciences,
LLC for an industrial facilities tax exemption certificate.
Held public hearing and approved revisions to the resolution previously
approved on the application from Styron, LLC for an industrial facilities tax
exemption certificate.
Held public hearing and approved revisions to the resolution previously
approved on the application from Styron, LLC for the transfer of an industrial
facilities tax exemption certificate.
Held first reading of an ordinance amending Article
I and Article II – Uniform Fire Code of Chapter 8, and repealing Section 8-3
and 8-4 of Article I and Section 8-11 of Article II of Chapter 8.
Held first reading of an ordinance amending Chapter
21 by creating Article XIII – Fire Department Service Fees.
Held first reading of an ordinance amending Section
34-5 – Municipal Civil Infractions.
Accepted Easement Agreement from Meijer, Inc. for
public sanitary sewers.
Approved final plat of Countryside Estates No. 4 – a residential
subdivision of 13 lots on 7.06 acres located west of Dublin Avenue and south of
Countryside Drive.
Approved request to transfer location of an escrowed Class C licensed
business with Dance-Entertainment Permit, from 134 Ashman to 405 E. Main
Street.
Approved request to transfer ownership and location of an escrowed Class
C licensed business with Entertainment Permit, located at 5103 Eastman from
B.B. Banucks, Inc. to Waterfall Grill, LLC, 337 E.
Wackerly, and a new Dance Permit.
Waived bid requirement and approved purchase of 13,400
gallons of unleaded fuel from Hirschman Oil of Reese, Michigan for $38,431.20
that was executed by the Purchasing Agent on September 13, 2011.
Waived bid requirement and approved purchase of 12,800
gallons of diesel fuel from Karbowski Oil of Bay City, Michigan for $38,361.60
that was executed by the Purchasing Agent on September 28, 2011.
Authorized issuance of purchase order to Miracle
Recreation of Okemos, Michigan for the Grove Park Accessible Play Structure in
the amount of $38,827.70.
Authorized issuance of purchase order to Valk Manufacturing of New Kingston, Pennsylvania for the
purchase of Carbide Cutting Blades for snow plowing operations in the amount of
$22,961.60.
Set a public hearing for Monday, November 21, 2011, at 7:00 p.m. to
consider Conditional Use Permit No. 41 – Eastman Senior Apartments.
Set a public hearing for Monday, November 14, 2011, at 7:00 p.m. to
consider a request to install a dedicated bike lane on both sides of Swede
Avenue between E. Wackerly Street and E. Patrick Road.
Set a public hearing for Monday, October 24, 2011, at 7:00 p.m. on the
First Amendment to the Urban Cooperation Act Agreement between the City of
Midland and the Charter Township of Larkin.
Gave job performance review for City Attorney James O. Branson III, and authorized a 1.5% of base one time merit pay, administrative correction to longevity pay and provided for performance evaluations prior to July 1st of every year.
Gave job performance review for City Manager Jon Lynch and
authorized a 2% of base one time merit pay, up to $500 annually for memberships
and dues to local civic organizations and provided for performance evaluations
prior to July 1st of every year.
