Planned Unit Developments
The planned unit development (PUD) process is an alternative to traditional
lot-by-lot development. The intent is to combine project elements such as
housing, streets, open space, recreation areas, and commercial/office uses –
into a functional unit that is integrated with the natural features of a site.
There is flexibility in lot configuration and structure placement. Existing
density restrictions apply, but can be calculated based on a project basis with
the entire parcel (rather than single lots) as the unit of regulation. This can
permit development which allows housing to be clustered (grouped close together)
and the ability to transfer density throughout the project site.
Because the PUD process diverges from traditional zoning, it requires a set
of special review standards. Stringent site review standards are applied, and
elected officials have discretionary authority in the approval process. The PUD
technique can be applied to any land use or mix of uses if permitted by local
ordinance.
Time Required
The average time required for approval of a planned unit development request
varies between 60 to 90 days.
The applicant should consult the Planning Department for advice regarding the
feasibility of the intended planned unit development.
Procedure
Petitioner
Submits application for the planned unit development to the City Planning
Department along with a $225 filing fee. Check must be made payable to The City
of Midland.

Planning Department
Sets a public hearing date for the petition and places a notice of the hearing
in the newspaper not less than five (5) nor more than fifteen (15) days prior to
the date of the hearing.
All property owners within three hundred (300) feet of the subject property are
notified of the public hearing by first class mail.
Prepares a staff report for the Planning Commission.
Planning Commission
Conducts a public hearing.
Recommends approval, denial, or modified approval to the City Council within
sixty (60) days of receipt of the application.
City Council
Receives the recommendation and proposed planned unit development request from
the Planning Commission.
Sets date for public hearing.
Places notice of the hearing in the newspaper not less than five (5) nor more
than fifteen (15) days prior to the date of the public hearing.
All property owners within three hundred (300) feet of the subject property are
notified of the public hearing by first class mail.
Conducts public hearing.
Approves, approves with modification, or denies planned unit development request
within forty-five (45) days of the receipt of the Planning Commission’s
recommendation.
