Yard/Rummage Sale Signs
Section 22-2(a) of the City’s Code
of Ordinances governs the placement of signs advertising rummage sales, homes
for sale, open houses, or business/ contractor advertisement signs in the public right-of-way. The right-of-way includes the sidewalk and the
area between the sidewalk and the curb, commonly called the outlawn. If there is
no sidewalk, this area would be considered about 15 feet or more
from the curb line towards the residence.
In response to Midland citizens' input on the issue, City Council adopted a
resolution in October 2006 that allows for the placement of rummage/yard sale
signs as long as certain requirements are met. Those requirements are listed
below, and outlined in the YouTube video at right.

Yard/rummage sale signs
may be placed on your property for up to four (4) consecutive
days.

The maximum size of each sign
may be six (6) square feet.

The top of each sign
must be no
more than 30” above the elevation of the crown of the roadway.

Each sign must have the owner’s
name and address affixed to it.

Signs in locations other than
the site of the advertised activity may only be placed with the consent of
the owner of the private property abutting the public right-of-way on which
signs are located.

Signs placed in the public right-of-way may not obstruct or otherwise interfere with
vehicular or pedestrian traffic.

Each sign may be placed inside
the public right-of-way from Thursday at 8:00 a.m. to Monday at 8:00 a.m.
After Monday at 8:00 a.m., signs must be removed.
In addition, the Code of Ordinance stipulates that signs may
not be attached to trees, power poles, or signs in the outlawn.
Additional Thoughts on Rummage/Garage Sales: No permit is required to hold a garage/rummage sale. In general, such sales are limited to three (3) days per event with no more than three (3) events per year. For more information, contact the Planning Department at 989-837-3374.
